Driftly — Terms of Service

1. Acceptance of terms

By downloading, installing, or using the Driftly mobile application (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not install or use the Service.

These Terms form a binding agreement between you and TechOne Digital (Cong ty TNHH Cong Nghe So TechOne), a company registered in Vietnam ("Driftly", "we", "us", or "our").

2. Service description

Driftly is a mobile application that provides:

Driftly is provided as a wellness tool. It is not a medical device or a medical service.

3. Eligibility

You must be at least 13 years old to use the Service (per Google Play's general age floor). To purchase a Driftly Premium subscription, you must be at least 18 years old or have the consent of a parent or legal guardian.

If you are using the Service on behalf of a company or other legal entity, you represent that you have authority to bind that entity to these Terms.

4. Account

4.1 Anonymous-first auth

The first time you open Driftly, an anonymous account is created automatically — no email, no password, no personal information required. This allows you to use the Service immediately.

4.2 Optional sign-in

You may optionally sign in via Sign in with Apple or Sign in with Google. Signing in links your existing anonymous account to your Apple or Google identity, allowing you to recover access if you uninstall the app, change devices, or sign in on another platform.

4.3 One account per person

You agree to maintain only one Driftly account per person. Creating multiple accounts to abuse the free trial (see §5.2) violates these Terms and will result in account termination.

4.4 Account security

You are responsible for safeguarding the credentials of any Apple or Google identity linked to your Driftly account. We are not liable for any loss or damage arising from your failure to keep those credentials secure.

5. Subscriptions and billing

5.1 Plans and pricing

Driftly Premium is offered in two plans:

5.2 Free trial

Driftly offers a 7-day free trial of Premium. The trial activates automatically when you complete the sleep quiz. No credit card or payment information is required to start the trial. This is a "reverse trial" — you experience Premium first, then decide whether to subscribe.

You may use the free trial only once per Driftly account. We use a has_used_trial latch to prevent trial abuse; circumventing it (e.g., by creating multiple accounts) violates these Terms.

5.3 Auto-renewal

If you choose to subscribe at or after the end of your free trial, your Driftly Premium subscription auto-renews at the end of each billing period (monthly or yearly) at the then-current price, unless you cancel at least 24 hours before the renewal date.

5.4 Cancellation

You may cancel your subscription at any time:

Cancelling stops future renewals. You retain access to Premium features until the end of the current billing period. Driftly does not process cancellations directly — all subscription state is managed by Google Play (Android) or Apple (iOS).

5.5 Refunds

Refund requests are handled per Google Play's refund policy. Driftly does not issue refunds outside of Google Play's process. To request a refund:

  1. Open Google Play Store → Account → Order history.
  2. Find the Driftly transaction → tap Request a refund.
  3. Submit your reason. Google reviews and decides.

5.6 Price changes

We will provide at least 30 days' advance notice of any price increase, by in-app notification or email (if you have provided one). Continued use of the Service after a price increase takes effect constitutes acceptance of the new price.

6. Free tier (post-trial)

After the 7-day free trial expires, if you choose not to subscribe, you retain access to the free tier:

The Premium-only features include the AI personalization engine (Thompson Sampling adjustments), full 50-sound library, 12 sleep stories, and the sound mixer's save-custom-mix capability.

All audio content shipped with Driftly is either:

8. AI personalization disclaimer

Driftly uses a Thompson Sampling recommendation algorithm to suggest sound mixes based on your morning ratings. The recommendations are statistical, not medical or clinical advice. Driftly does not predict your sleep quality, diagnose any condition, or guarantee any outcome.

If a recommendation does not work for you on a given night, your morning rating will tell the system to try something different the next night. The system improves over the first 14 nights and continues to refine your mix over time.

9. Medical disclaimer

Driftly is not a medical device and does not diagnose, treat, cure, or prevent any sleep condition. Please consult a healthcare professional for medical sleep concerns.

Driftly is a wellness app, not a medical product. It does not replace medical advice, diagnosis, or treatment for any sleep disorder including but not limited to insomnia, sleep apnea, restless legs syndrome, parasomnias, or circadian rhythm disorders.

If you have any health concerns, including persistent difficulty sleeping, please consult a qualified healthcare professional. Do not delay seeking medical advice because of something you read or experienced in Driftly. If you are experiencing a medical emergency, contact your local emergency services immediately.

11. Termination

11.1 Termination by you

You may stop using the Service at any time. To delete your account and all associated data, follow the steps in §11 of the Privacy Policy.

11.2 Termination by us

We may suspend or terminate your access to the Service if you breach these Terms, including (without limitation) the acceptable-use provisions in §10 or the trial-abuse prohibition in §5.2.

11.3 Effect of termination

Upon termination, your right to access and use the Service ceases. Sections that by their nature should survive termination (Liability, Disclaimer, Governing Law, Medical Disclaimer) will continue in effect.

12. Disclaimers and limitation of liability

12.1 Service provided "as is"

The Service is provided "as is" and "as available", without warranty of any kind, express or implied, including (without limitation) warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free from harmful components.

12.2 No warranty for outcomes

We do not warrant that the Service will help you sleep, will be effective for your sleep concerns, or will work the same way for every user. Sleep is highly individual.

12.3 Limitation of liability

To the maximum extent permitted by applicable law, Driftly's total liability to you for any claim arising out of or related to these Terms or the Service is limited to the amount you paid to us in the twelve (12) months preceding the claim. Driftly will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or sleep.

This limitation does not apply where prohibited by applicable law (e.g., personal injury due to gross negligence in jurisdictions that prohibit such limitations).

13. Governing law and disputes

These Terms are governed by the laws of the Socialist Republic of Vietnam, without regard to its conflict-of-laws principles.

Any dispute arising out of or related to these Terms or the Service that cannot be resolved through good-faith negotiation will be resolved by arbitration administered by the Vietnam International Arbitration Centre (VIAC) under its rules in force at the time. The seat of arbitration will be Hanoi. The language of arbitration will be Vietnamese (with English translations available on request).

If you reside outside Vietnam, applicable consumer-protection laws of your jurisdiction may grant you additional rights that these Terms cannot waive.

14. Changes to these terms

We may update these Terms from time to time. We will update the "Last updated" date at the top of this document and, for material changes, display an in-app banner on the next Driftly launch following the update. Continued use of the Service after the update constitutes acceptance of the revised Terms.
